<strong><span style="font-size: 15px;"> 案件来源：</span></strong><span style="font-size: 15px;">2019年4月17日上午，我局执法人员在市场检查时，发现当事人在位于平昌县金宝新区道路旁以展示牌的形式发布内容为“黄金水岸、三梯四户独立电梯入户，平昌县金宝新区，开发商：友合地产，270度水岸生活，建面约100-130㎡空中平墅”等字样的房地产广告，现场当事人不能提供《土地使用证》及《商品房预售许可证》。<br/></span>

<span style="font-size: 15px;"> 调查认定的事实：当事人于2019年2月初在平昌帝相广告经营部制作内容为“黄金水岸，三梯四户独立电梯入户，平昌县金宝新区，开发商：友合地产，270度水岸生活，建面约100-130<span style="font-size: 15px; letter-spacing: 2px; text-align: justify;">㎡</span>空中平墅”等字样的房产广告(广告内容由当事人提供)。制作好后，当事人又于2019年3月3日开始，将上述广告内容放置在位于平昌县金宝新区道路旁以展示牌的形式对外发布。<br/></span>
</p>
<p style="letter-spacing: 2px; line-height: 1.75em; text-align: justify; margin-top: 10px; margin-bottom: 10px;">
<span style="font-size: 15px;"> 现查明：当事人在未经依法取得《土地使用证》和《商品房预售许可证》的情况下，擅自发布房地产广告，我局执法人员进一步查明，截止我局执法人员2019年4月17日检查时，当事人发布的广告中涉及的房产还未销售，所以无营业额和利润。<br/></span>
</p>

<span style="font-size: 15px;"> 上述事实，主要有以下证据证明：<br/></span>
</p>
<p style="letter-spacing: 2px; line-height: 1.75em; text-align: justify; margin-top: 10px; margin-bottom: 10px;">
<span style="font-size: 15px;"> 1、现场检查笔录1份，证明当事人违法现场的情况；<br/></span>
</p>
<p style="letter-spacing: 2px; line-height: 1.75em; text-align: justify; margin-top: 10px; margin-bottom: 10px;">
<span style="font-size: 15px;"> 2、被委托人询问笔录1份，证明当事人违法的事实和经过；<br/></span>
</p>

<span style="font-size: 15px;"> 3、法定代表人授权委托书1份，证明被委托人接受调查的法律依据；<br/></span>

<span style="font-size: 15px;"> 2019年6月3日，本局依法向当事人送达了川市监巴平告字(2019) 0183号《平昌县市场监督管理局行政处罚告知书》，当事人在法定期限内未提交书面陈述、申辩意见。<br/></span>
</p>
<p style="letter-spacing: 2px; line-height: 1.75em; text-align: justify; margin-top: 10px; margin-bottom: 10px;">
<span style="font-size: 15px;"> 鉴于当事人在接受调查期间，主动配合执法人员检查， 积极提供相关证据材料，也未对社会造成危害后果，故当事人的违法行为尚来达到从重处罚的程度，我局决定给予当事人从轻处罚。根据《四川省工商行政管理规范行政处罚行政强制裁量权实施办法》第六条第四款“从轻处罚是指在行政处罚的法定种类和法定幅度内，适用较轻的种类或者选择法定幅度中较低的部分予以处罚，单处罚款的幅度为法定自由裁量最低处罚额度以上最高处罚额度的30%以下，有底数的另加底数。”<br/></span>
</p>
<p style="letter-spacing: 2px; line-height: 1.75em; text-align: justify; margin-top: 10px; margin-bottom: 10px;">
<span style="font-size: 15px;"> 当事人的行为违反了《房地产广告发布规定》第五条“凡下列情况的房地产，不得发布广告：(一) 在未经依法取得国有土地使用权的土地上开发建设的；（四）预售房地产，但未取得该项目预售许可证的；”的规定，属违法行为。依据《房地产广告发布规定》第二十一条“违反本规定发布广告，《广告法》及其他法律法规有规定的，依照有关法律法规规定予以处罚。法律法规没有规定的，对负有责任的广告主、广告经营者、广告发布者，处以违法所得三倍以下但不超过三万元的罚款；没有违法所得的，处以一万元以下的罚款。”。我局决定：处罚款2000.00元。</span>

<p style="text-align: justify; line-height: 1.75em; letter-spacing: 2px; margin-top: 10px; margin-bottom: 10px;">
<span style="font-size: 15px;"> 当事人收到本处罚决定书之日起十五日内到平昌县工商银行(账户:平昌县工商和质量技术监督管理局，账号:2318596109026403001)缴纳罚款，逾期不撒纳，每日按罚款数额的3%加处罚款，并申请人民法院强制执行。</span>
